Do You Know Marriage Registration Procedure And Importance?

In India, ‘Marriage Registration’ is considered a very important aspect of a marriage to provide it, the legal status in the eye of the law. Until and unless you register your marriage and receive a marriage certificate, your marriage won’t be considered legal. Hence, as a legal proof for the marital status, the Supreme Court of India made it mandatory for all married couples (without considering religion aspect) to register for a marriage certificate.

Every Indian couple of all religions needs to register for a Marriage Certificate immediately after marriage because of the following importance:

  • Marriage Certificate provides a couple ‘Social Security’ and ‘Confidence.’
  • Marriage Certificate is considered valuable evidence of marriage as per the law.
  • Marriage Certificate is helpful in getting Visas and Passport.
  • Marriage Certificate is considered an important document in claiming band deposits, life insurance, property, and investments, etc.

So, this is why, every married couple needs to possess their marriage certificate based on the type of their marriage procedure such as (Court Marriage, Parsi Marriage, Hindu Marriage and Arya Samaj Marriage Procedure etc.) simply by registering for the marriage certificate under the following acts:

  • Hindu Marriage Act, 1955: Couples who belong to Hindu, Buddhist, Jains, Sikhs, and Arya Samaj can register their marriage certificate under this law. The couples who married as per this law can register their marriages in the office of the Registrar of Marriage under whose jurisdiction the marriage took place.
  • Parsi Marriage and Divorce Act, 1936: Couples who belong to Parsies and Zoroastrians can register their marriage certificate under this law. The marriages under this act need to be registered in the Office of the District Registrar under whose jurisdiction the marriage solemnized.
  • Special Marriage Act, 1954: Couples who belong to all other religions can register their marriage certificate under this law. Similarly, marriages under this act need to be registered in the office of the Marriage Officer under whose jurisdiction the couple resides.

Procedure for Marriages Certificate Registration under ‘Hindu Marriage Act:’

  • First you need to download the form, from the ‘State Stamps and Registration’ site.
  • Then, fill the form with all the required details such as the name and address of both the parties.
  • After that, take the signature of the eye-witnesses who witnessed your marriage along with mentioning their name and address on the form.
  • Once you complete entering all the necessary details, paste one of your marriage photographs as proof of marriage. (Remember to sign across it)
  • That’s it! Then, submit the form to the Marriage Officer (as mentioned above) along with the fee and wait till the officer issues the certificate.

Procedure for Marriages Certificate Registration under ‘Parsi Marriage Act:’

  • Once the Parsi priest had solemnized the marriage, collect your marriage certificate form from him that includes the signature of the bride, groom, and two eyewitnesses.
  • Then, send the same certificate form to your particular (as mentioned above) Marriage Officer for your marriage registration along with the fee.

Procedure for Marriages Certificate Registration under ‘Special Marriage Act:’

  • Similar to the procedure under the ‘Parsi Marriage Act’ collect the marriage certificate form; from the place, the marriage solemnized for example ‘Arya Samaj Marriage Certificate from Arya Samaj Mandir.’
  • Then, visit the office of the Sub-Divisional Magistrate (SDM) and provide the same to the Marriage Officer (as mentioned above) along with the fee to receive the Marriage certificate.
